Retired Justice John Paul Stevens is one of the longest serving Supreme Court justices, and he dissented on Bush v Gore amid the recount that propelled Bush to the presidency. Writing for a three-judge panel of the U.S. District Court in Washington, Kavanaugh ruled two foreign citizens living in the United States on temporary work visas could not spend money to call for the election of American politicians.

Stevens said he, too, has come to believe that Kavanaugh, a US appellate judge, "demonstrated a potential bias involving enough potential litigants before the (high) court that he would not be able to perform his full responsibilities". "It's not healthy to get a new justice who can only do a par-time job". Kavanaugh wrote that his testimony "reflected my overwhelming frustration at being wrongly accused".

The incident allegedly took place when they were both in high school. Stevens was unanimously confirmed by the U.S. Senate in 1978. He added the nominee lacks the temperament for the position, the Post reported.

A fellow judge on the panel, Karen LeCraft Henderson, forwarded more than a dozen misconduct complaints to Roberts after concluding that the reports were substantive enough that they should not be investigated by fellow judges on the same panel. He was replaced by current Justice Elena Kagan.
