Trump Asks Supreme Court to Let Trans Military Ban Take Effect

After the Trump administration asked the supreme court to issue an unusually quick ruling on the Pentagon's policy of restricting military service by transgender people, critics said the request was likely only to complicate a deteriorating relationship between the president and the federal judiciary.

Transgender advocates have slammed Trump's ban as bigoted and say it will only harm the military, as it would, if implemented, expunge the more than 10,000 transgender people who now serve in the armed forces.

Under Trump's plan, transgender people would only be allowed to serve in the military in "limited circumstances".

It defined such individuals as "those who may require substantial medical treatment, including through medical drugs or surgery".

That proposal replaced President Trump's plan to ban all transgender military members, which he announced via Twitter in 2017. Trump's recent salvo against the "Obama judge" who ruled against his asylum policy - not an issue now before the supreme court - prompted Roberts to fire back at the president for the first time, for feeding perceptions of a biased judiciary.

Although the Supreme Court nearly always waits for a federal appeals court to render a final decision on a case before the justices will review it, federal law and Supreme Court rule 11 give the justices jurisdiction over a case at any point after it is first docketed with the appellate court.

The Trump administration argued Friday that the Supreme Court should get involved in this case early because it "involves an issue of imperative public importance: the authority of the USA military to determine who may serve in the nation's armed forces".

While the US Court of Appeals for the 9th Circuit has heard arguments but not yet issued an opinion; the US Court of Appeals for the DC Circuit is scheduled to hear an appeal of the ruling in December, the Post noted.
